24 August 2016 To the Registrar, High Court, Wellington Attached is an urgent application for recall of the judgment of France J on the grounds that new evidence has become available which clearly establishes reasonable doubt regarding the evidence of the complainant and Police, the application includes a request for waiver of filing fee. This decision is vitally relevant to proceedings currently before the Human Rights Review Tribunal, for this reason we request it be dealt with URGENTLY as a substantial miscarriage of justice has occurred, it is clear that the Court discriminated unfairly against Mr Mihaka and that his previous lawyers acted negligently in not bringing these matters to the attention of the Court during the previous appeals.
